Aviva Pension Skill – Terms and Conditions

Please read these terms carefully before using the Aviva Pension Skill. Your attention is particularly drawn to the disclaimer and limitation of liability provisions in Clause 7 and the indemnity in Clause 8.

These terms of use (“Terms”) are a legal agreement between you (“you”) and Aviva UK Digital Limited (“Aviva”, “us” or “we”) in respect of your use of Aviva’s pension skill (“Skill”) which enables you to receive information about your pension and other products you have with the Aviva Group of Companies, to the extent already made available to you through your MyAviva account. The Alexa service is made available by Amazon Digital Services LLC and/or its affiliates (“Amazon”). In order to use the Skill, you will first need to enable the Skill through your Alexa service (either from the Amazon website or the Alexa mobile application) subject to Amazon’s terms of use.

By accessing or using the Skill you agree to be bound by these Terms. If you do not agree to these Terms, we do not grant you permission to use the Skill and you should not proceed to download or use the Skill.

Please note that the pension values provided to you are the latest available as at the date of your request. Such pension values are not guaranteed and they may go up and down, and you may get back less than the amount that you invested. For further information about your pension please refer to your scheme documents.

1. Your rights to use the Skill

Subject to you agreeing to abide by these Terms, we grant you permission to use the Skill which includes the right and access to view your information on the Aviva webpages made available through the Alexa service on the Amazon website or in the Alexa mobile application (“Aviva Webpages”).

When you enable the Skill through your Alexa service, we will ask you to authenticate yourself as a MyAviva customer by entering your security credentials. If you do not already have a MyAviva account, you will be re-directed to the MyAviva website so that you can create one. In order for us to verify that you are an Aviva customer, and before you can use the Skill, you must register for a MyAviva account.

We reserve all other rights which are not granted in these Terms. You may use the Skill for personal non-commercial purposes only. We may revoke the permission and/or rights granted in these Terms at any time without notice and with or without cause.

2. Information we collect from you and how we use it

You agree to: (a) provide accurate, current and complete information during the set up process for the Skill; (b) promptly update your MyAviva profile, and any other information you provide to us, as appropriate; and (c) maintain the confidentiality of your MyAviva account as well as your user ID, password and any other authentication information in connection with the Skill. You are entirely responsible for all activities that occur through use of your user ID, even if another person was using your account and/or Alexa enabled device at the relevant time.

You hereby authorise us to verify any information that you provide to us to the extent permitted by applicable law if we deem this is necessary to confirm your identity and your suitability and eligibility to use the Skill. However, we shall be under no obligation to verify such information and may rely on the information that you provide to us without taking any further action.

We will send you communications and notices to the email address you provide in your profile or otherwise elect in your account settings. However, we will not send you any marketing communications without the appropriate permission to do so. Please see our Privacy Policy for more details.

We have the right to disable any user ID, password or other authentication information in connection with your account whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

3. Your promises to us

You promise to us that: (a) you are authorised to agree to these Terms; and (b) your use of the Skill shall be entirely at your own risk.

4. Intellectual property

All content available from Aviva through or in connection with the Skill is the property of or licensed to Aviva. Such content shall not be modified, distributed, framed, republished, scraped or sold in any form or by any means, in whole or in part, without our prior written permission. You acknowledge that all intellectual property rights in the Skill anywhere in the world belong to us (or are licensed to us), and that such rights are licensed (not sold) to you, and that you have no rights in, or to, the Skill other than the right to use it in accordance with these Terms.

5. Protecting your privacy

Your interactions with us through or in relation to the Skill are subject to our Privacy Policy.

6. Your use of the Alexa service

The Skill is accessible through the Alexa service on an Alexa-enabled device. You acknowledge that we have no control over the functioning of the Alexa service or the Alexa-enabled device and we are not responsible for their availability or for any inaccuracies in your interactions with us through the Alexa service via your Alexa-enabled device. You do not need the Skill to access your pension information; all of the information available through the Skill is also available via Aviva’s website, the MyAviva platform and through our contact centres. You are responsible for all costs associated with your use of the Alexa service and purchase of the Alexa-enabled device.

You authorise us to provide information via your Alexa-enabled device in accordance with your security settings which may, for example, allow your device to retrieve information about your pension from us based on a verbal request from anyone who uses your device or to save information about your pension for easier access.

When downloading and using the Skill, you must not:

  • access, or attempt to access, parts of the Skill that are not intended for public use;
  • modify, adapt or reverse engineer any aspect of the Skill;
  • attempt to disrupt or interfere with the Skill in any way or with another person's use of the Skill or use the Skill as a means of disrupting or interfering with the Alexa service;
  • probe, scan or test the vulnerability of the Skill;
  • insert or knowingly or recklessly transmit or distribute a virus into the Skill so as to cause harm to our sites, us or other users or which is likely to bring the Skill, our products our services or us into disrepute;
  • impersonate any person, or entity or misrepresent your affiliation with any person or entity;
  • assist, encourage or permit any other person to do any of the acts described above.

When a breach of these Terms has occurred, we may take such action as we consider appropriate in the circumstances.

Your use of the Alexa service and any Alexa-enabled device will be governed by Amazon’s terms and conditions and privacy policies (“Amazon Terms”). It is your responsibility to read the Amazon Terms. If you do not understand or agree to be bound by the Amazon Terms, you should not use the Alexa service or any Alexa-enabled device. Where there is a conflict between Amazon Terms and these Terms, the Amazon Terms will apply to the extent of that conflict.

7. Disclaimer and limitation of liability

You acknowledge and agree that the information and advice that you receive from or in relation to the Skill may not be complete, up-to-date or reliable. You must: (a) make use of a wide range of information, advice and resources available to you; and (b) always exercise your own informed and reasonable judgment regarding the best course of action to follow. You acknowledge and agree that any actions taken by you, whether in reliance on the information received from the Skill or otherwise, are by your decision alone and are undertaken at your own risk.

Accordingly, to the maximum extent permitted by law and subject to the sections below, we will only be responsible for reasonably foreseeable losses you suffer as a result of your use of, inability to use, or your reliance upon information provided through or in relation to the Skill, whether such losses arise in contract, tort (including negligence) or otherwise.

Aviva’s maximum liability under or in connection with these Terms whether in contract, tort (including negligence) or otherwise shall in all circumstances be limited to £10. As the Skill is provided for domestic and personal use, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Nothing in these Terms will limit or exclude Aviva’s liability for: (a) death or personal injury resulting from our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.

We provide the Skill and Aviva Webpages on an “as is” and “as available” basis. We make no guarantee that these will be uninterrupted, error free, or free from viruses or other harmful components. While we take reasonable precautions to prevent the existence of computer viruses and/or other malicious programs, we accept no liability for them. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms, which may apply to the Skill or Aviva Webpages, whether express or implied.

8. Indemnity

You agree to compensate and hold Aviva, its affiliates and each of its directors, officers, agents, contractors, partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of your misuse of the Skill (including your use of the Aviva Webpages) and/or arising from a breach of these Terms.

9. Your right to terminate

You may terminate your use of the Skill at any time via the Alexa service by disabling the Skill from your Alexa app. This will automatically disengage the account linking to your MyAviva account.

We may terminate these Terms and your permission to use the Skill immediately if: (a) you commit any breach of these Terms; (b) we discontinue the Skill; (c) we are prevented from providing the Skill for any reason, or (d) for any other reason as we see fit.

Furthermore, we reserve the right to change, edit, suspend, delete and/or cancel any part of the Skill (including your access to the Aviva Webpages) at any time with or without notice to you.

On termination of these Terms for any reason: (a) all rights granted to you under these Terms will immediately cease; (b) you must immediately cease all activities authorised by these Terms; and (c) you acknowledge that we may restrict your access to the Skill.

When your use of the Skill ceases, any provision of these Terms that expressly or by implication is intended to come into or continue in force on or after termination shall remain in full force and effect.

10. Other important Terms

We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or obligations under these Terms.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce any of our rights against you, or if we delay in doing so, that will not mean that we have waived any of our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Each of the conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect. Other than as expressly set out in these Terms, no third party is intended to have any right or ability to enforce any of the provisions of these Terms.

These Terms constitute the entire agreement and understanding between you and us relating to the subject matter of these Terms and supersede any prior agreement or understanding between you and us relating to the subject matter of these Terms.

You acknowledge that you have not entered into these Terms in reliance on, and shall have no remedies in respect of, any representation or warranty that is not expressly set out in these Terms (other than in respect of any fraudulent misrepresentation).

These Terms are governed by English law and the courts of England will have non-exclusive jurisdiction.

11. Changes to Terms and/or service

We may change these Terms and/or the Skill at any time (for example to improve performance, enhance functionality, reflect changes to the operating system or to address security issues). We will notify you of a change when you next use the Skill or access the Aviva Webpages (we may also email you about any material changes to these Terms and/or the Skill). You will be required to agree to any new Terms in order to continue your use of the Skill. The date these Terms were last updated appears at the bottom.
